Misinterpreting Customary Forests

Putting customary forests into the social forestry scheme violates the Constitutional Court’s verdict. Regulations about customary forests must be constructed.

A DECADE ago, May 16, to be exact, the Constitutional Court (MK) gave a nod to the request to review Law No. 41/1999 on Forestry, against the Constitution. The request was filed by the Nusantara Indigenous Communities Alliance, Kuntu Customary Community Association, and Kasepuhan Cisitu Customary Community Association.
